What to say when making an enquiry

Please identify:

  • The parties;
  • Who you act for;
  • The broad nature of the credit hire or regulatory issue;
  • The amount at stake, where relevant;
  • The procedural stage;
  • The hearing date or appeal deadline;
  • The work required: advice, drafting, conference or advocacy;
  • Any particular urgency.

Urgent work and appeals

If the matter is urgent, say so at the beginning of the enquiry. In an appeal, please identify the decision date and appeal deadline prominently.

Where possible, send the judgment or order with the initial enquiry so that the nature and urgency of the proposed work can be assessed quickly.

What to send for a credit hire case

  • Pleadings;

  • Witness statements;
  • Financial evidence if impecuniosity is in issue;
  • Rates evidence;
  • Repair, total-loss or replacement documents;
  • Intervention correspondence;
  • Relevant expert evidence;

  • A short note identifying the real issues.

What to send for an appeal

  • The judgment or note of judgment;
  • The order under appeal;
  • The submissions or skeleton arguments used below;
  • The evidence relevant to the proposed grounds;
  • Any draft grounds;
  • The appeal deadline;
  • A short explanation of the alleged error.

What to send for agreement or regulatory advice

  • The agreement or proposed agreement;
  • Terms, notices and customer-facing documentation;
  • A description of the customer journey and sign-up process;
  • Relevant marketing, scripts or online wording;
  • Referral or introduction arrangements where relevant;
  • A concise description of the business model;
  • The precise question on which advice is sought.

Fees

My clerks can provide a quotation once the proposed work, volume of papers, urgency and hearing requirements are understood. For appropriate advisory and drafting work, it may be possible to agree a fixed fee in advance.

Routes of instruction

I am generally instructed through solicitors and other authorised professional clients. If you are unsure whether you are able to instruct without a solicitor, please contact my clerks so that they can advise on the appropriate route of instruction.

One useful rule

A short note identifying the real problem is usually more useful than a large unexplained bundle. If there is a deadline, put it at the top.
